Guardianship & Conservatorships

Unfortunately, the time may come in an individual's life when they become incapacitated and can no longer manage his or her affairs or take care of himself or herself. If this happens, a family member or other concerned person may ask the county probate court to protect the incapacitated individual and appoint a guardian and/or conservator. This process is also available for the care of a mentally disabled person allowing a parent or family member to ask the court for the appointment of a guardian on his or her behalf. This also arises when a minor stands to receive a monetary gift, inheritance or personal injury recovery making it necessary for a person to be appointed as conservator of his or her estate until attaining the age of 18.
